| Listings that violate Collectors Network policies may result in the removal of the listing, or disciplinary action, including warnings, account suspension of account termination. Clever Monkey Media LLC will consider the circumstances of the offense and the user's trading history before taking any disciplinary action. Excessive Shipping & Handling Sellers are encouraged to list the shipping and handling charges in the item listing. Due to current postal regulations, it is sometimes difficult to determine shipping until the buyer's location is known. Buyer should contact the seller before bidding or purchasing an item to clear up any questions not answered in the item listing. If the seller does not list the actual shipping charges in the item listing, then charges should reflect that seller's actual cost to ship the item(s). Sellers may charge a reasonable shipping and handling fee to final price of their item, reflecting the seller's reasonable costs for mailing, packaging and handling the item. Shipping and handling fees cannot be listed as a percentage of the final sale price. In cases where the seller has stated a shipping and handling fee upfront, the seller is not required to combine shipping on multiple items unless prior arrangements have been made between the buyer and seller prior to bidding or purchasing the item. Payment Surcharges Sellers may not charge a buyer additional fees for the use of common forms of payment, including checks, money orders, electronic transfer, credit cards and online payments. These costs should be built into the price of the item. Some forms of payment surcharges, such as credit card surcharges, are illegal under the laws of some states. Sellers may only add a surcharge to the final price under the following circumstances: - Sellers may charge a reasonable shipping and handling fee to the final price of their item. This fee should be disclosed in the listing. Shipping and handling fees can cover the seller's reasonable costs for mailing, packaging and handling the item. This can not be listed as a percentage of the final sale price. - Sellers may charge the costs associated with using third party escrow services, if they buyer chooses to use an escrow service. - If a sellers accepts payment in a different currency than US dollars, than the seller may pass along to the buyer any costs associated with the currency exchange if the buyer chooses to make payment in the optional payment method. Such costs must be disclosed and agreed to in advance by the buyer. Bonuses and Prizes Sellers can provide bonus item to buyers within their listing, as long as the seller states the exact price at which the bonus will apply. In multiple item listings, the seller must offer the exact same bonus item to all buyers. Giveaways, Raffles and Prizes Listing promoting giveaways, random drawings or prizes as an enticement for buyers are not permitted. These promotions are regulated by law and may be illegal in some states. Non-relevent Category Listings Users may not list items in non-relevent categories. Violation of this policy may result in the removal of the item listing, or the listing will be moved to the appropriate category. JavaScript Sellers are not permitted to use JavaScript to write or access cookies, or redirect the user to another page. Keyword Spamming Including brand names or other inappropriate or irrelevent keywords in the title or description for the purpose of directiong attention to a listing is prohibited. Music in Listings Sellers are prohibited from adding music or sound clips to item listings. Sound files cause page listings to load slowly, and are annoying to buyers. In addition, many of these sound files are copyrighted and could expose the seller to legal liability. Links in Listings Sellers are allowed to place the following types of links the item listing: - A single link to your personal or company web site. The link must be to the main page or sub category page, and cannot link directly to the specific product in the listing. - Links to photos of the item in the listing. - Links to your email address (link must open an email client). - A single link to a page describing the item sold in the listing. - Links to your Collectors Network profile and feedback page. - A single link to your purchase terms and conditions, provided that the essential information is stated within the listing itself. - Links to payment management services or shipping calculators. - Links giving credit to third parties for picture hosting, counters, listing software and payment services. The link may contain a small logo, company name and description about the service only, and cannot contain any other information about the company. The seller must be using the service in conjunction with the listing to use a third party credit. Links to pages not listed above are prohibited. Copyrighted Information In Listing Users are prohibited from placing copyrighted information in their item description. This includes copyrighted images, music and text. Copyright protection attaches to a work the moment it is fixed in tangible form and prevents others from exploiting the work without permission. It is not necessary for copyrighted materials to be marked or registered for protection to be extended to the copyrighted owner. However, registration is usually necessary to file legal actions regarding your copyright. Right of Publicity and privacy laws prohibit the unauthorized commercial use of another's likeness, name or signature on a product. Collectors Network prohibits any listing containing the unauthorized commercial use of another's likeness, name or signature. Unauthorized use of trademarks Sellers are prohibited from using trademarks in listings without permission from the trademark owner. This include keyword spamming with unrelated trademarks. However, sellers can use trademarks when listing items containing the trademark. If you an unsure about your ability to use a trademark in your listing, please contact an attorney for more information. Selling copyrighted material without permission Sellers are prohibited from selling any copyrighted material they do not have permission to sell. Generally, the owner of a copyrighted work is entitled to resell the particular copy they own, unless the license excludes resale (e.g., promotional or academic material and software). If you an unsure about your ability to resale copyrighted material, please contact an attorney for more information. Copyright protection includes the exclusive right to distribute or sell the copyrighed work. This prohibits sellers from giving away of a copy of the work. Sellers are prohibited from selling an non-infringing item, and including copyrighted material for free that they do not have permission to sell or giveaway. Sellers refusal to sell items Upon receipt of a successful purchase offer or winning bid, sellers are expected to accept payment and deliver the item to the buyer. However, there are some cases where sellers are no longer able to complete the transaction. Sellers should contact tthe buyer and explain the situation. Sellers repeatedly refusing to complete a transaction may be subject to account suspension or termination. Sign posts Signs post are listing meant to direct a user to a seller's store, web site or other listings. Signs post listing are prohibited. Listings containing fraudulent or imporperly described items are prohibited. Sellers who knowingly fail to disclose information about the authenticity of an item, alterations or other information that might have an impact on the item's value may have the listing removed. Sellers with a pattern of deceptive listing practices may be subject to account suspension or termination. Reserve Price Policy Users are prohibited from engaging in the following activities: - Stating in the auction listing that a highbidder is obligated to purchase the item even if the reserve price is not met. - Stating a reserve price in the auction listing when the item has not been listed using the reserve price feature. If the reserve price is not met, the seller can make a counter offer to the auction bidders. Please see the counter offer section for more information. Misleading Titles Sellers are prohibited from listing items with titles that are misleadings or do not accurately describe the listed item. Tax Policy Sellers are required to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of Collectors Network and your listing. Your are responsible for paying all applicable taxes related to your sale. Why was one listing removed, while other similar items were not removed? Clever Monkey Media LLC removes listing that are prohibited under the terms, conditions and policies of Collectors Network. Most listings are removed because of a user complaint. Similarly listed items will be removed if the Collectors Network adminstrators are notified about them. How do I know if an item is illegal to sell? The Collectors Network policies contain a partial listing of prohibited or illegal items. If you are unsure an item is illegal to sell, please contact an attorney or local agency that may know the laws regarding your item for more information. How do I report illegal, infringing or fraudulent listings, or other violations of the terms, conditions and policies? If you feel a listing is illegal, infringing or fraudulent, or a user is violating the terms, conditions and policy of Collectors Network, please report the violation to us. Violation of this policy may result in the removal of your listing. Depending on the severity of the offense, you may be subject to account suspension or termination. Clever Monkey Media LLC reserves that right to suspend a member immediately from our site for violations of the Forum Usage Policy. Sanctions may range from one day to indefinite, depending on the severity of the infraction.
